The Internet Access Service (the ‘Service’) is provided to you by WCTA Ltd, The Shrine Office, 2 Common Place, Walsingham, Norfolk, NR22 6EE. By gaining access to the Service, you agree to abide by the terms and conditions below (the ‘Terms’).
If you do not agree to all of the Terms, please do not use
the Service.
WCTA Ltd has implemented a Fair Use Policy so that we can deliver a broadband service that is reliable to all our visitors. Please be considerate to other visitors using the Service by limiting large downloads and file sharing. We may monitor the performance of our network and if your usage is frequently high and impacts our network and the experience of other visitors in a negative way, we will ask you to change your behaviour or restrict your use to ensure that the majority of our visitors using the Service have a good experience.
We
will use our reasonable endeavours to make the Service available 24 hours a
day, however we will not be liable if for any reason the Service is not available
at any time or for any period, nor for any loss of data or damage to equipment
you suffer as a result of using our Service. Access to the Service may be
suspended at any time for any reason, including routine or emergency
maintenance of the Access Points. For this reason we strongly recommend that
you regularly save any work you are doing whilst using the Service.
The
Service we provide is intended to allow you to access the Internet in order to
use, amongst other things, the World Wide Web and E-mail. You undertake to us
that you will use the Service responsibly and that you will behave in a lawful,
honest and proper manner. Without prejudice to any other provision of this
agreement, we may terminate your use of the Service at any time without notice
if we become aware of any behaviour that has a negative impact on our equipment
or network or the use by other customers of our equipment or network or the
Internet in general, or which damages, or has the potential to damage, our reputation
or standing.
Users
of this service: -
a) do
so at their own risk, using their own wireless-equipped computing equipment;
b) will
not hold The Shrine (WCTA Ltd) responsible for any loss or damage, however
sustained;
c) will
not use the service for any unlawful purpose or use the service in any way
which may violate or infringe the rights of any individual, firm or company or
may be construed as defamatory, offensive, abusive, obscene or which may cause
unnecessary anxiety or inconvenience to others;
d) will
have properly installed, up to date and functioning Firewall and Anti-Virus
software, The Shrine will not be responsible if your equipment becomes infected
whilst using our Internet connection;
e) will
not disclose the Password/Wireless Network Key to anyone.
f) will
not use the Service in such a manner as to host a web or other server, send or
facilitate the sending of bulk e-mail or collect party personal data without
appropriate consent;
We
shall investigate any suspected breach of the agreement by you, and reserve the
right to take such action as we, in our sole discretion deem appropriate,
including suspension or withdrawal of the Service with immediate effect and
without notice to you.
You
acknowledge that your use of the Service is at your own risk. The Service is
provided on an ‘as-available’ basis, and to the fullest extent permitted by
law, we hereby exclude all and any warranties or conditions of any kind,
whether express or implied, in respect of the Service and any content or data
obtained or downloaded from it. Without prejudice to the foregoing generality;
we do not warrant that the Service will be uninterrupted, timely secure or
error-free at all times or will meet your requirements; and we are not responsible
for the security, integrity, accuracy or completeness of any information that
you transmit or receive while using the Service.
The
disclaimer under this paragraph is without prejudice to your statutory and
other rights as a consumer.
Nothing
in this agreement serves to exclude or limit our liability for death or
personal injury caused by our negligence.
Subject
to paragraph 7 we shall not be liable to you in contract, tort or otherwise
arising in connection with this agreement for any economic losses (including,
without limitation, loss of revenue, profits, contracts, business or
anticipated savings), any loss of goodwill or reputation, any special indirect
or consequential losses or any destruction of loss of data.
If
any part of the Service is not available we shall not be obliged to pay any
compensation to you.
You
will indemnify us against all and any losses or claims arising from any breach
of the agreement by you, and against any claims or legal proceedings arising
from your use of the services, which are brought or threatened against us by
another person.
We
reserve the right to change these Terms and Conditions at any time without
notice. It is your responsibility to familiarise yourself with the Terms and
Conditions regularly to ensure that you are aware of any changes.
Please note Internet traffic may be
logged and any inappropriate activity will be forwarded to the authorities.
If you do not agree
to all of the Terms & Conditions, please do not use the Service.
